QR Code Access & Public Accessibility Disclaimer

Legacy Preserved, LLC ("Legacy Preserved," "Company," "we," "our," or "us")

1. QR Code Accessibility

Each Legacy Preserved™ memorial plaque, marker, or related product may include a QR code that links to a digital memorial, tribute, or other associated online content (the "Tribute Experience"). Unless otherwise expressly identified by Legacy Preserved as a restricted-access experience, QR codes are intended to function as publicly scannable links. Any person who is physically able to access the QR code and possesses a compatible smartphone, camera, or QR code reader may be able to access the associated Tribute Experience.

2. Public Display

Legacy Preserved does not control the physical environment in which a QR code is installed or displayed. Once installed on a headstone, memorial, monument, plaque, bench, cemetery marker, or other publicly or privately accessible location, the QR code may be visible and accessible to members of the public. Accordingly, Legacy Preserved does not represent or warrant that access to a publicly displayed QR code will be limited to family members, invited guests, or other intended recipients.

3. Customer Responsibility

The purchaser, account holder, or authorized representative is solely responsible for:

  • Selecting the installation location;
  • Determining whether publicly accessible placement is appropriate;
  • Choosing what information, photographs, videos, audio recordings, or other materials are included within the Tribute Experience;
  • Obtaining all necessary permissions and rights for uploaded content.

Customers should carefully consider the public nature of any QR code before activating or displaying a Legacy Preserved product.

4. Privacy Expectations

Customers acknowledge that a publicly displayed QR code may be scanned by individuals who were not specifically intended to view the Tribute Experience. If customers desire greater control over access, they should utilize any privacy or access-control features that Legacy Preserved may make available. No security feature is absolute, and Legacy Preserved cannot ensure that unauthorized access will not occur.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Legacy Preserved, LLC, its officers, directors, employees, contractors, affiliates, licensors, and service providers shall not be liable for any loss, claim, damage, or expense arising from or related to:

  • Scanning or viewing of a publicly displayed QR code;
  • Unauthorized access to publicly available Tribute Experiences;
  • Sharing, copying, downloading, or redistribution of publicly accessible content by third parties;
  • The visibility, placement, condition, or accessibility of any QR code after installation;
  • Interruption of access caused by internet service providers, mobile networks, third-party hosting providers, or other factors beyond the Company's reasonable control.

6. No Warranty

Legacy Preserved makes no express or implied warranty that any publicly displayed QR code or Tribute Experience will remain private, confidential, inaccessible to third parties, or immune from unauthorized viewing. Except as expressly stated in the Company's Terms of Service, all products and services are provided "AS IS" and "AS AVAILABLE."

7. Acceptance

By purchasing, activating, installing, or using any Legacy Preserved™ product or service, the customer acknowledges that they have read, understood, and agreed to this QR Code Access & Public Accessibility Disclaimer, together with the Company's Terms of Service and Privacy Policy.
